Recommendations of session relevant to 'Personal Status Law for Christians'

On Thursday, April 18, the Young Women Christian Association (YWCA), in cooperation with the "Initiative of Female Lawyers Towards Change "held a session chaired by Her Excellency Reem Abu Hassan and Director of the YWCA Hania Qaqish during which a final statement and recommendations were issued dealing with the "Personal Status Law… Facts and Challenges''.
The session issued the following recommendations:

1. The intention is to establish a department for guidance and family harmony for litigants before the ecclesiastical courts to ensure impartiality of judges.

2. Emphasizing the need for a unified system of fees in the ecclesiastical courts in a way that takes into account the interests of the disputing parties and makes the possibility of reference to the judiciary accessible to all.

3. Activating the role of mediation in the ecclesiastical courts and creating a special system to include the formation of independent committees to meet this end.

4. Finding a mechanism to determine the amount of alimony to be paid in order to ensure fairness and impartiality in assessing the conditions of both women and men, and to ensure the continuation of a decent life for children in the event of family separation or divorce.

5. Raising the age of custody to 15 years in line with national laws and international standards to achieve the best interests of children and ensure them a safe and stable.

6. Amending Article 279 of the Penal Code as follows: (Notwithstanding the provisions of the applicable personal law or other laws whoever marries off a female under the legal age shall be punished in line with the same law).

7. Emphasizing the importance of launching unified laws that deal with personal status issues, including all issues relevant to family including engagement, marriage, custody, alimony, adoption, inheritance as well as address the problems of conversions.

8. Establishing a center specialized in Canon Law with the support of the Jordanian government and religious institutions in order to train and qualify judges and employees in ecclesiastical courts so as to ensure specialized and qualified judiciary.

9. Empowering women to be represented in the ecclesiastical system.

10. Urging the state to ensure periodic review of the laws relevant to the personal status of Christians by specialized committees in accordance with the principles of justice.

11. Orienting the role of civil society institutions to serve the personal status issues of Christian families such as the establishment of guest houses for children and a specialized center to provide guidance and legal support.

12. Conducting further research and studies on the personal status of Christians and provision of legal information in cooperation with officially accredited bodies, including theological universities and academic centers specialized in Canon Law.
